These Terms and Conditions apply to the GiftHub application, which is operated by Nimblewire.
1. Acceptance of Terms
By accessing or using the GiftHub application, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the application.
2. Use of the Service
GiftHub allows users to create, manage, and share wishlists with friends and family.
You agree to use the GiftHub application only for lawful purposes and in compliance with these Terms.
Nimblewire reserves the right to suspend or terminate accounts that violate these Terms or misuse the platform.
3. Account Eligibility
GiftHub is intended solely for individual, personal use. Accounts may not be registered by or on behalf of any corporation, LLC, partnership, or other business entity. By creating an account, you represent and warrant that you are an individual acting in a personal, non-commercial capacity.
4. User Accounts
Certain features of the GiftHub application may require you to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Nimblewire is not responsible for any unauthorized access to or use of your account.
5. Privacy and Data Use
Your privacy is important to us. Nimblewire collects and uses personal information in accordance with the GiftHub Privacy Policy. By using the GiftHub application, you consent to the collection and use of your information as described in that policy.
6. Content and Intellectual Property
Users retain ownership of the content they create within the GiftHub application, including wishlists and saved items.
By using the GiftHub application, you grant Nimblewire a non-exclusive, royalty-free, and limited license to host, display, and share your content solely as necessary to operate and improve the service.
All branding, design, software, and intellectual property associated with the GiftHub application are owned by Nimblewire and may not be copied, modified, or distributed without prior written permission.
7. Prohibited Activities
You agree not to use the GiftHub application to:
Engage in fraudulent, deceptive, or illegal activities.
Upload, share, or distribute harmful, abusive, or offensive content.
Attempt to interfere with, disrupt, or gain unauthorized access to the platform or its systems.
8. Permitted and Prohibited Links
Users are welcome to post links to third-party websites, retailers, and online platforms (such as Amazon, Target, Walmart, or similar) for informational or community purposes. However, users may not post links to any website, page, social media profile, storefront, or platform that they own, operate, control, or have a direct or indirect commercial interest in. This includes, but is not limited to, business homepages, brand or product websites, personal online stores, and referral or affiliate URLs that generate personal financial benefit for the user.
9. Limitation of Liability
The GiftHub application is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Nimblewire shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the application.
10. Account Termination
Nimblewire reserves the right, at its sole discretion and without prior notice, to suspend or permanently terminate any account that it reasonably believes to be operated by or on behalf of a business entity, or that has been used to post self-promotional, commercial, or advertising content in violation of these Terms. No refund of any fees paid will be issued upon termination for violations of this section.
11. Modifications to These Terms
Nimblewire may update these Terms and Conditions from time to time. Continued use of the GiftHub application after changes are posted constitutes acceptance of the revised terms.
